&nbsp;辽宁省人民政府令(第196号)<br /><strong>第一条</strong> 为了保护劳动者获得劳动报酬的权利，规范用人单位的工资支付行为，维护和谐的劳动关系，根据《中华人民共和国劳动法》和有关法律、法规，结合我省实际，制定本规定。<br /><strong>第二条</strong> 我省行政区域内的各类企业、个体经济组织、民办非企业单位（以下统称用人单位）和与之形成劳动关系的劳动者，适用本规定。<br />国家机关、事业单位、社会团体和与之建立劳动合同关系的劳动者，依照本规定执行。<br /><strong>第三条</strong> 省、市、县（含县级市、区，下同）劳动和社会保障行政部门负责本行政区域用人单位的工资支付管理工作。<br />建设、财政、税务、人事、工商行政管理、经济综合管理等有关行政部门按照各自职责，做好工资支付管理的有关工作。<br /><strong>第四条</strong> 工会组织依法对用人单位的工资支付进行监督，有权对用人单位的工资支付违法行为予以纠正或者向政府及其有关部门提出建议，并为劳动者依法维护获得劳动报酬的权利提供支持和帮助。<br /><strong>第五条</strong> 任何组织和个人都有权举报用人单位的工资支付违法行为。<br />政府鼓励、支持并依法保护新闻媒体对用人单位的工资支付行为实施舆论监督。<br /><strong>第六条</strong> 省、市劳动和社会保障等有关部门应当根据本行政区域经济社会发展水平和劳动力供求状况等因素，定期制定和发布工资水平宏观调控政策。<br /><strong>第七条</strong> 用人单位应当根据当地政府有关工资水平宏观调控政策，结合劳动力市场价位和本单位经济效益，经与工会组织或者劳动者集体协商，确定本单位的工资水平。<br /><strong>第八条</strong> 用人单位应当根据本单位的经济效益增长情况、当地政府发布的工资指导线、工资指导价位和本地区、行业的劳动者平均工资水平，逐步提高劳动者的工资水平。<br /><strong>第九条</strong> 用人单位应当依法制定本单位的工资支付制度，并向本单位全体劳动者公布。<br />工资支付制度主要包括下列事项：<br />（一）工资支付的项目、标准和形式；<br />（二）工资支付的周期和日期；<br />（三）加班工资计算基数；<br />（四）工资扣除事项；<br />（五）特殊情况下的工资支付；<br />（六）有关工资支付的其他事项。<br /><strong>第十条</strong> 用人单位与劳动者应当在劳动合同中约定工资标准。工资标准根据劳动者所在岗位或者所从事的工作确定。<br /><strong>第十一条</strong> 用人单位应当凭劳动和社会保障行政部门核准的《工资总额使用手册》，在其开立的银行基本存款账户支取工资性现金。<br /><strong>第十二条</strong> 用人单位应当以法定货币支付工资，不得以实物、有价证券等代替货币支付。<br />用人单位应当按照约定的日期支付劳动者工资。遇法定节假日或者休息日，应当提前在最近的工作日支付工资。<br /><strong>第十三条</strong> 用人单位应当自用工之日起计算劳动者工资。<br /><strong>第十四条</strong> 用人单位可以以小时、日、周、月为周期支付工资。按完成一定工作任务计发工资的，应当在工作任务完成的当日支付劳动者工资。<br />用人单位应当至少每月向劳动者支付一次工资。<br /><strong>第十五条</strong> 用人单位必须书面记录支付劳动者工资的数额、时间、领取者姓名，并保存两年以上备查，劳动者有权查询和核对本人的工资支付情况。用人单位可以将工资直接支付给劳动者本人，也可以委托银行代发。<br />用人单位必须向劳动者提供一份本人工资清单，工资清单必须与实际支付的工资相符。<br /><strong>第十六条</strong> 用人单位直接向劳动者本人支付工资的，应当办理签收手续。劳动者本人因故不能领取工资时，可以委托亲属或者他人代领。<br />用人单位委托银行代发工资的，应当在约定的日期将劳动者的工资足额存入其本人账户。受托银行在工资支付中发生劳动者不能按时领取工资或者工资数额差异等问题，由用人单位负责与受托银行协调解决。<br /><strong>第十七条</strong> 实行年薪制或者按考核周期计发工资的，用人单位应当每月按不低于当地最低工资标准预付劳动者工资，年终或者考核周期届满时结算。<br /><strong>第十八条</strong> 劳动者与用人单位形成劳动关系后，在试用、实习期间提供正常劳动的，用人单位支付的工资不得低于当地最低工资标准。<br /><strong>第十九条</strong> 用人单位不得随意扣除劳动者工资。<br />除法律、法规规定可以代扣劳动者工资的事项外，用人单位扣除劳动者工资应当符合集体合同、劳动合同的约定或者本单位依法制定的规章制度的规定。每月扣除的部分，不得超过劳动者当月工资的20%；扣除后的余额，不得低于当地最低工资标准。<br /><strong>第二十条</strong> 用人单位与劳动者双方依法终止、解除劳动合同的，用人单位应当一次付清劳动者工资。<br /><strong>第二十一条</strong> 除实行不定时工作制的以外，用人单位安排劳动者在法定标准工作时间以外工作的，应当按照下列标准支付劳动者加班工资：<br />（一）延长工作时间的，按照不低于劳动者本人小时工资基数的150％支付；<br />（二）休息日工作不能安排同等时间补休的，按照不低于劳动者本人日工资基数或者小时工资基数的200%支付；<br />（三）法定节假日工作的，按照不低于劳动者本人日工资基数或者小时工资基数的300％支付。<br /><strong>第二十二条</strong> 计算加班工资的日或者小时工资基数和休假期间的工资，应当按照劳动合同中约定的劳动者本人工资标准确定；劳动合同没有约定的，按照集体合同约定的加班工资基数以及休假期间工资标准确定；劳动合同、集体合同均未约定的，按照劳动者本人正常工作应得的工资确定。<br />依照前款规定确定的加班工资基数以及假期工资，不得低于当地最低工资标准。<br /><strong>第二十三条</strong> 实行计件工资制的用人单位，应当科学、合理地确定劳动定额和计件单价，并予以公布。劳动者在完成计件定额任务后，用人单位安排加班的，应当分别按照不低于计件单价的150%, 200%, 300％支付加班工资。<br /><strong>第二十四条</strong> 实行综合计算工时工作制的用人单位，在综合计算工时周期内，应当按照劳动者实际工作时间计算其工资。劳动者实际工作时间总和超过法定工作时间的部分，视为延长工作时间，应当按照本规定支付加班工资。<br /><strong>第二十五条</strong> 实行非全日制工作时间的用人单位，应当实行小时工资制。小时工资由用人单位与劳动者协商确定，但不得低于当地非全日制就业劳动者的小时最低工资标准。<br /><strong>第二十六条</strong> 劳动者在依法享受年休假、探亲假、婚假、丧假等休假期间，用人单位应当支付工资。劳动妇女节、青年节等部分公民节日期间，用人单位安排劳动者休息或者参加节日活动的，应当视同其提供正常劳动予以支付工资；劳动者照常工作的，不支付加班工资。<br /><strong>第二十七条</strong> 劳动者在事假期间，用人单位可以不支付其工资。<br /><strong>第二十八条</strong> 劳动者患病或者非因工负伤停止劳动的，在规定的医疗期内，用人单位应当根据劳动合同或者集体合同的约定支付病假工资，但不得低于当地最低工资标准的80% 。<br /><strong>第二十九条</strong> 劳动者因工伤或者患职业病停止工作的，停工留薪期的工资支付依照国务院《工伤保险条例》的规定执行。<br /><strong>第三十条</strong> 劳动者因生育或者计划生育手术休假期间，其工资待遇依照《辽宁省人口与计划生育条例》的规定执行。<br /><strong>第三十一条</strong> 劳动者在法定工作时间内依法参加下列社会活动期间，用人单位应当视同其提供正常劳动予以支付工资：<br />（一）依法行使选举权、被选举权的活动；<br />（二）人民代表大会代表履行职务的活动；<br />（三）以本单位劳动者代表身份参加本单位的集体协商活动；<br />（四）工会基层委员会依法开展工会活动；（五）人民法院通知出庭作证；<br />（六）义务献血、参加民兵组织训练或者预备役训练；<br />（七）宪法、法律规定的公民应当履行义务的其他活动。<br /><strong>第三十二条</strong> 劳动者经单位批准参加脱产、半脱产学习、进修、培训的，其工资待遇由用人单位与劳动者协商确定。<br /><strong>第三十三条</strong> 劳动者被人民法院判处管制或者拘役、有期徒刑适用缓刑的，或者被假释、监外执行、取保候审的，在此期间用人单位未与其解除劳动合同，劳动者继续在原单位正常劳动的，用人单位应当按照劳动合同约定或者本单位依法制定的规章制度执行。<br />劳动者被依法判处拘役以上刑罚，或者被依法采取限制人身自由的强制措施以及受到限制人身自由的行政处罚的，用人单位不支付其被限制人身自由期间的工资。<br /><strong>第三十四条</strong> 用人单位因生产经营困难暂时无法按时支付工资的，经与工会组织或者劳动者代表协商一致后，可以按照协商的日期支付工资，除实施改制的用人单位外，延期支付工资不得超过30日。超过30日的，应当向当地劳动和社会保障行政部门备案。<br />实施改制的用人单位，改制前拖欠劳动者工资的，必须在改制方案中明确支付被拖欠工资的时间和数额。<br /><strong>第三十五条</strong> 用人单位停工、停业在一个工资支付周期内的，应当按照合同约定的标准支付劳动者工资；超过一个工资支付周期的，可以根据劳动者提供的劳动，按照双方重新约定的标准支付劳动者工资。劳动者提供了正常劳动的，支付的工资不得低于当地最低工资标准。<br /><strong>第三十六条</strong> 用人单位解除劳动关系的决定被劳动争议仲裁委员会或者人民法院依法裁决撤销或者判决无效的，应当支付劳动者被违法解除劳动关系期间的工资，其工资标准为本市同期在岗职工的平均工资；劳动者本人工资高于本市同期在岗职工平均工资的，按照劳动者本人前12个月的平均正常工作时间工资计算。<br /><strong>第三十七条</strong> 用人单位破产、终止或者解散的，经依法清算后的财产应当按照有关规定，优先用于支付欠付的劳动者工资和社会保险费。<br /><strong>第三十八条</strong> 用人单位有下列情形之一的，劳动者有权向劳动和社会保障行政部门投诉、举报：<br />（一）未按劳动合同或者集体合同约定支付工资的；<br />（二）以低于当地最低工资标准支付工资的；<br />（三）克扣或者无故拖欠工资的；<br />（四）以实物、有价证券等代替货币支付工资的；<br />（五）违反本规定的其他情形。<br /><strong>第三十九条</strong> 劳动和社会保障行政部门应当向社会公布投诉、举报电话，完善投诉、举报处理制度和案件查处督办制度。<br /><strong>第四十条</strong> 劳动和社会保障行政部门对于拒不纠正无故拖欠或者克扣劳动者工资行为的用人单位，应当记录在案并纳入企业信用评价系统，及时向社会发布其不良用工信用记录公告，同时通报税务、海关、银行、工商行政管理、招投标机构等有关单位。对用工信用不良记录被公告的用人单位，政府及有关部门不得授予该用人单位及其法定代表人或者负责人任何荣誉称号。<br /><strong>第四十一条</strong> 农村进城务工劳动者集中的用人单位，必须根据劳动和社会保障行政部门的书面通知，定期向其报告用工和工资支付情况。<br /><strong>第四十二条</strong> 对发生过无故拖欠劳动者工资行为的用人单位，实行工资保证金制度。发生过无故拖欠劳动者工资行为的建筑施工企业，必须在建设工程开工前，按照工程合同价款的一定比例，在规定日期向银行专户预存工资保证金。<br />发生过拖欠工程款的建筑开发企业，必须在开发新项目前提供担保。工资保证金和工程担保制度的具体实施办法，由省劳动和社会保障行政部门、省建设行政部门等有关部门制定，报省政府批准后施行。<br /><strong>第四十三条</strong> 劳动和社会保障行政部门查处无故拖欠工资或者克扣工资案件时，用人单位和劳动者都不能对工资数额举证的，可以参照该用人单位同岗位劳动者的平均工资或者本市在岗职工的平均工资水平，按照有利于劳动者的原则认定工资数额。<br /><strong>第四十四条</strong> 劳动者和用人单位之间因工资支付发生争议的，可以向本单位劳动争议调解委员会申请调解，当事人一方也可以向劳动争议仲裁委员会申请仲裁。对仲裁裁决不服的，可以依法向人民法院提起诉讼。<br /><strong>第四十五条</strong> 用人单位有下列情形之一的，由劳动和社会保障行政部门责令限期改正；逾期不改正的，处500元以上1000元以下罚款：<br />（一）未制定工资支付制度或者工资制度未向劳动者公布的；<br />（二）未向劳动者本人提供工资支付清单的；<br />（三）未使用《工资总额使用手册》支取工资的；<br />（四）未按规定保存工资支付凭证的。<br /><strong>第四十六条</strong> 用人单位克扣或者无故拖欠工资，或者支付劳动者的工资低于当地最低工资标准的，由劳动和社会保障行政部门责令限期足额支付劳动者工资；逾期不支付的，责令用人单位按照应付金额的50％以上1倍以下的标准计算，向劳动者加付赔偿金。<br /><strong>第四十七条</strong> 用人单位未按规定缴纳工资保证金的，由劳动和社会保障行政部门处1000元罚款，劳动和社会保障、建设等有关行政部门可以依法采取行政措施或者申请人民法院强制执行。<br /><strong>第四十八条</strong> 用人单位抗拒、阻挠劳动和社会保障行政部门监督检查，或者不按其要求报送书面材料，隐瞒工资支付事实，出具伪证或者隐匿、毁灭证据的，由劳动和社会保障行政部门依照国务院《劳动保障监察条例》的有关规定处罚。<br /><strong>第四十九条</strong> 用人单位无故拖欠工资，致使劳动者难以追偿其工资而引发严重影响公共秩序事件的，由公安机关对用人单位法定代表人或者负责人依法给予治安管理处罚；构成犯罪的，依法追究刑事责任。<br /><strong>第五十条</strong> 劳动者或者用人单位对劳动和社会保障行政部门作出的行政处理决定或者行政处罚决定不服的，可以依法申请行政复议或者提起行政诉讼。用人单位逾期既不申请复议，也不提起诉讼，又不履行处理决定或者处罚决定的，由劳动和社会保障行政部门申请人民法院强制执行。<br /><strong>第五十一条</strong> 劳动和社会保障等有关行政部门工作人员对符合受案条件的举报不予受理或者发现工资支付违法行为不予查处以及有其他滥用职权、徇私舞弊、玩忽职守行为的，依法给予行政处分；有犯罪嫌疑的，移交司法机关依法处理。<br />&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <strong>第五十二条</strong> 本规定下列用语的含义：<br />&nbsp;&nbsp;&nbsp; （一）正常劳动，是指劳动者在法定工作时间或者依法签订的劳动合同约定的工作时间内履行了劳动义务。<br />&nbsp;&nbsp;&nbsp; （二）克扣工资，是指除本规定第十九条规定的情形外，用人单位对于提供了正常劳动的劳动者不支付工资（含加班工资，下同）或者未足额支付工资的行为。<br />&nbsp;&nbsp;&nbsp; （三）无故拖欠工资，是指除自然灾害等不可抗力和实施改制的用人单位外，用人单位延期支付工资超过30日的行为。<br />&nbsp;&nbsp;&nbsp; （四）工会组织，是指用人单位依法成立的工会组织及其上级工会组织。<br />&nbsp;&nbsp;&nbsp;&nbsp; <strong>第五十三条</strong> 劳动者的日工资，按国家工时制度的规定，每月以平均工作时间20. </span></span>二<span lang="EN-US">00</span>四年三月一日<span lang="EN-US"><br /></span><span lang="EN-US"><br /></span><span lang="EN-US"><br /></span> <span lang="EN-US"><span style="mso-spacerun: yes">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span></span>辽宁省劳动合同规定<span lang="EN-US"><br /></span><span lang="EN-US"><br /></span>第一章 总 则<span lang="EN-US"><br /></span>第一条 为了规范劳动关系，保护劳动合同当事人的合法权益，根据《中华人民共和国劳动法》及有关法律、法规，结合我省实际，制定本规定。<span lang="EN-US"><br /></span>第二条 本省行政区域内的企业、个体经济组织和民办非企业单位<span lang="EN-US">(</span>以下统称为用人单位<span lang="EN-US">)</span>与劳动者建立或者形成劳动关系，适用本规定。<span lang="EN-US"><br /></span>国家机关、事业单位、社会团体与劳动者建立或者形成劳动合同关系，依照本规定执行。<span lang="EN-US"><br /></span>第三条 劳动合同是劳动者与用人单位建立劳动关系，明确双方权利和义务的协议。<span lang="EN-US"><br /></span>订立和变更劳动合同，应当遵循平等自愿、协商一致的原则，并符合法律、法规、规章的有关规定。<span lang="EN-US"><br /></span>劳动合同依法订立即具有法律约束力，当事人必须履行约定的义务。<span lang="EN-US"><br /></span>第四条 省、市、县<span lang="EN-US">(</span>含县级市、区，下同<span lang="EN-US">)</span>人民政府劳动和社会保障行政部门负责本行政区域内劳动合同制度实施的监督管理。<span lang="EN-US"><br /></span>第五条 用人单位应当建立健全劳动合同的订立、变更、终止登记制度和合同档案保管制度。<span lang="EN-US"><br /></span>第六条 工会帮助，指导劳动者订立劳动合同，并依法对用人单位订立和履行劳动合同情况进行监督。用人单位违反劳动法律、法规、规章规定的，工会有权依法维护劳动者的合法权益。<span lang="EN-US"><br /></span>第二章劳动合同的订立和履行<span lang="EN-US"><br /></span>第七条 劳动者在签订劳动合同前，有权了解用人单位规章制度、工作内容、劳动时间、劳动报酬、劳动条件、职业病危害和社会保险等有关情况，用人单位应当如实说明。<span lang="EN-US"><br /></span>用人单位在招用劳动者时，有权了解劳动者健康状况、知识技能和工作经历等有关情况，劳动者应当如实说明。<span lang="EN-US"><br /></span>第八条 用人单位自用工之日起即与劳动者形成劳动关系。用人单位与劳动者应当在用工之日前以书面形式订立劳动合同。劳动合同由劳动者签字，用人单位和其法定代表人加盖印章。<span lang="EN-US"><br /></span>第九条 劳动合同应当载明用人单位的名称、地址和劳动者的姓名、性别、年龄、住址和居民身份证号码等基本情况，并具备以下条款：<span lang="EN-US"><br /></span><span lang="EN-US">(</span>一<span lang="EN-US">)</span>劳动合同期限<span lang="EN-US">(</span>含起始日<span lang="EN-US">)</span>；<span lang="EN-US"><br /></span><span lang="EN-US">(</span>二<span lang="EN-US">)</span>工作内容及要求；<span lang="EN-US"><br /></span><span lang="EN-US">(</span>三<span lang="EN-US">)</span>劳动保护和劳动条件；<span lang="EN-US"><br /></span><span lang="EN-US">(</span>四<span lang="EN-US">)</span>劳动报酬、支付方式和支付时间；<span lang="EN-US"><br /></span><span lang="EN-US">(</span>五<span lang="EN-US">)</span>社会保险和福利待遇；<span lang="EN-US"><br /></span><span lang="EN-US">(</span>六<span lang="EN-US">)</span>劳动纪律；<span lang="EN-US"><br /></span><span lang="EN-US">(</span>七<span lang="EN-US">)</span>教育与培训；<span lang="EN-US"> <br /></span><span lang="EN-US">(</span>八<span lang="EN-US">)</span>劳动合同终止的条件；<span lang="EN-US"><br /></span><span lang="EN-US">(</span>九<span lang="EN-US">)</span>违反劳动合同的责任；<span lang="EN-US"> <br /></span><span lang="EN-US">(</span>十<span lang="EN-US">)</span>法律、法规、规章规定和双方约定的其他条款。<span lang="EN-US"><br /></span>第十条 劳动合同期限分为有固定期限、无固定期限和以完成一定的工作为期限。以固定期限作为劳动合同条款的，合同期限不能少于<span lang="EN-US">30</span>日。<span lang="EN-US"><br /></span>劳动合同未约定起始日的，以当事人签字或者盖章的时间为准。当事人签字或者盖章时间不一致的，以最后一方签字或者盖章的时间为准。<span lang="EN-US"><br /></span>补签的劳动合同，以劳动关系形成之日为起始日，合同期限自补签字之日起不得少于<span lang="EN-US">6</span>个月。<span lang="EN-US"><br /></span><span style="COLOR: black">第十一条 当事人可以在劳动合同期限条款中约定试用期。试用期间应当支付合理的劳动报酬。<span lang="EN-US"><br /></span>除国家另有规定外，约定的试用期按照下列规定执行：<span lang="EN-US"> <br /></span><span lang="EN-US">(</span>一<span lang="EN-US">)</span>合同期限在<span lang="EN-US">6</span>个月以下的，不得超过<span lang="EN-US">15</span>日；<span lang="EN-US"><br /></span><span lang="EN-US">(</span>二<span lang="EN-US">)</span>合同期限在<span lang="EN-US">6</span>个月以上<span lang="EN-US">1</span>年以下的，不得超过<span lang="EN-US">30</span>日；<span lang="EN-US"><br /></span><span lang="EN-US">(</span>三<span lang="EN-US">)</span>合同期限在<span lang="EN-US">1</span>年以上<span lang="EN-US">2</span>年以下的，不得超过<span lang="EN-US">60</span>日；<span lang="EN-US"><br /></span><span lang="EN-US">(</span>四<span lang="EN-US">)</span>合同期限在<span lang="EN-US">2</span>年以上<span lang="EN-US">3</span>年以下的，不得超过<span lang="EN-US">90</span>日；<span lang="EN-US"><br /></span><span lang="EN-US">(</span>五<span lang="EN-US">)</span>合同期限在<span lang="EN-US">3</span>年以上的，不得超过<span lang="EN-US">6</span>个月。<span lang="EN-US"><br /></span></span>用人单位因特殊情况需延长试用期的，劳动者有权要求其变更合同期限，或者要求对延长的试用期限按照非试用期的标准支付劳动报酬。用人单位必须应劳动者的要求及时变更合同期限，或者支付非试用期标准的劳动报酬。<span lang="EN-US"><br /></span>第十二条 当事人可以在劳动合同中约定保守商业秘密的条款，也可以单独签订保密协议。商业秘密进入公知状态后，保密条款或者保密协议自动失效。<span lang="EN-US"><br /></span>用人单位在与需要保守商业秘密的劳动者订立劳动合同时，可以协商约定解除劳动合同的提前通知期。提前通知期最长不得超过<span lang="EN-US">6</span>个月。在此期间，用人单位有权采取相应的脱密措施。<span lang="EN-US"><br /></span>第十三条 用人单位与劳动者订立劳动合同，不得以任何形式收取抵押金、保证金和其他费用，不得扣押劳动者的居民身份证、职业资格证和其他证件，也不得附加限制劳动者权利的任何条款。<span lang="EN-US"><br /></span>第十四条 有下列情形之一的，劳动合同中止履行：<span lang="EN-US"><br /></span><span lang="EN-US">(</span>一<span lang="EN-US">)</span>双方协商一致的；<span lang="EN-US"><br /></span><span lang="EN-US"><span style="mso-spacerun: yes">&nbsp;
