<div class="p_entry2" id="textboxContent"><br />（二○○八年五月二十一日 法发〔2008〕14号）<br /><br />为确保死刑案件的办理质量，根据《中华人民共和国刑事诉讼法》及相关法律、法规和司法解释的有关规定，结合人民法院刑事审判和律师辩护、法律援助工作的实际，现就人民法院审理死刑案件，律师依法履行辩护职责的具体问题规定如下：<br /><br />　　一、人民法院对可能被判处死刑的被告人，应当根据刑事诉讼法的规定，充分保障其辩护权及其他合法权益，并充分保障辩护律师依法履行辩护职责。司法行政机关、律师协会应当加强对死刑案件辩护工作的指导，积极争取政府财政部门落实并逐步提高法律援助工作经费。律师办理死刑案件应当恪尽职守，切实维护被告人的合法权益。<br /><br /><br />　　二、被告人可能被判处死刑而没有委托辩护人的，人民法院应当通过法律援助机构指定律师为其提供辩护。被告人拒绝指定的律师为其辩护，有正当理由的，人民法院应当准许，被告人可以另行委托辩护人；被告人没有委托辩护人的，人民法院应当通知法律援助机构为其另行指定辩护人；被告人无正当理由再次拒绝指定的律师为其辩护的，人民法院应当不予准许并记录在案。<br /><br /><br />　　三、法律援助机构在收到指定辩护通知书三日以内，指派具有刑事案件出庭辩护经验的律师担任死刑案件的辩护人。<br /><br /><br />　　四、被指定担任死刑案件辩护人的律师，不得将案件转由律师助理办理；有正当理由不能接受指派的，经法律援助机构同意，由法律援助机构另行指派其他律师办理。<br /><br />五、人民法院受理死刑案件后，应当及时通知辩护律师查阅案卷，并积极创造条件，为律师查阅、复制指控犯罪事实的材料提供方便。<br /><br />　　人民法院对承办法律援助案件的律师复制涉及被告人主要犯罪事实并直接影响定罪量刑的证据材料的复制费用，应当免收或者按照复制材料所必须的工本费减收。<br /><br />　　律师接受委托或者被指定担任死刑案件的辩护人后，应当及时到人民法院阅卷；对于查阅的材料中涉及国家秘密、商业秘密、个人隐私、证人身份等情况的，应当保守秘密。<br /><br /><br />　　六、律师应当在开庭前会见在押的被告人，征询是否同意为其辩护，并听取被告人的陈述和意见。<br /><br /><br />　　七、律师书面申请人民法院收集、调取证据，申请通知证人出庭作证，申请鉴定或者补充鉴定、重新鉴定的，人民法院应当及时予以书面答复并附卷。<br /><br /><br />　　八、第二审开庭前，人民检察院提交新证据、进行重新鉴定或者补充鉴定的，人民法院应当至迟在开庭三日以前通知律师查阅。<br /><br /><br />　　九、律师出庭辩护应当认真做好准备工作，围绕案件事实、证据、适用法律、量刑、诉讼程序等，从被告人无罪、罪轻或者减轻、免除其刑事责任等方面提出辩护意见，切实保证辩护质量，维护被告人的合法权益。<br />十、律师接到人民法院开庭通知后，应当保证准时出庭。人民法院应当按时开庭。法庭因故不能按期开庭，或者律师确有正当理由不能按期出庭的，人民法院应当在不影响案件审理期限的情况下，另行安排开庭时间，并于开庭三日前通知当事人、律师和人民检察院。<br /><br /><br />　　十一、人民法院应当加强审判场所的安全保卫，保障律师及其他诉讼参与人的人身安全，确保审判活动的顺利进行。<br /><br /><br />　　十二、法官应当严格按照法定诉讼程序进行审判活动，尊重律师的诉讼权利，认真听取控辩双方的意见，保障律师发言的完整性。对于律师发言过于冗长、明显重复或者与案件无关，或者在公开开庭审理中发言涉及国家秘密、个人隐私，或者进行人身攻击的，法官应当提醒或者制止。<br /><br /><br />　　十三、法庭审理中，人民法院应当如实、详细地记录律师意见。法庭审理结束后，律师应当在闭庭三日以内向人民法院提交书面辩护意见。<br /><br /><br />　　十四、人民法院审理被告人可能被判处死刑的刑事附带民事诉讼案件，在对赔偿事项进行调解时，律师应当在其职责权限范围内，根据案件和当事人的具体情况，依法提出有利于案件处理、切实维护当事人合法权益的意见，促进附带民事诉讼案件调解解决。<br /><br /><br />　　十五、人民法院在裁判文书中应当写明指派律师担任辩护人的法律援助机构、律师姓名及其所在的执业机构。对于律师的辩护意见，合议庭、审判委员会在讨论案件时应当认真进行研究，并在裁判文书中写明采纳与否的理由。<br /><br />人民法院应当按照有关规定将裁判文书送达律师。<br /><br /><br />　　十六、人民法院审理案件过程中，律师提出会见法官请求的，合议庭根据案件具体情况，可以在工作时间和办公场所安排会见、听取意见。会见活动，由书记员制作笔录，律师签名后附卷。<br /><br /><br />　　十七、死刑案件复核期间，被告人的律师提出当面反映意见要求或者提交证据材料的，人民法院有关合议庭应当在工作时间和办公场所接待，并制作笔录附卷。律师提出的书面意见，应当附卷。<br /><br /><br />　　十八、司法行政机关和律师协会应当加强对律师的业务指导和培训，以及职业道德和执业纪律教育，不断提高律师办理死刑案件的质量，并建立对律师从事法律援助工作的考核机制。</div>]]>

<p><br />　　最高人民法院关于审理人身损害赔偿案件适用法律若干问题的解释第二十九条&quot; 死亡赔偿金按照受诉法院所在地上一年度城镇居民人均可支配收入或者农村居民人均纯收入标准，按二十年计算。但六十周岁以上的，年龄每增加一岁减少一年；七十五周岁以上的，按五年计算。&quot; 死亡赔偿金是对受害人作为一个民事权利主体生命权的丧失（死亡）作出的赔偿。公民从出生时起到死亡时止，具有民事权利能力，依法享有民事权利，承担民事义务。而生命权则是一切权利的基础和前提，任何生命权的丧失都是公民民事权利能力的丧失。因此，死亡赔偿金实质是以受害人民事权利能力的丧失为给付条件。死亡赔偿金的性质，传统上有&quot;抚养丧失说&quot;和&quot;继承丧失说&quot;两种理论。&quot;抚养丧失说&quot;认为，因受害人死亡，受害人生前扶养的未成年人或者丧失劳动能力、又没有其他生活来源的成年近亲属，因此丧失了生活资源的供给来源，受有财产损害，侵权责任人应当对该项损害予以赔偿。但在很多情况下，受害人并没有需要抚养的近亲属，为平衡利益，法律规定对受害人近亲属因受害人死亡反射性精神利益损害，侵权责任人亦应当赔偿。我国的《民法通则》、《消费者权益保护法》、《产品质量法》、《道路交通事故处理办法》以及最高人民法院2001年3月公布施行的《精神损害赔偿司法解释》基本上采纳了这一理论，将死亡赔偿金定性为精神损失。&quot;继承丧失说&quot;认为，侵害他人生命致人死亡，不仅生命利益本身受侵害，而且造成受害人余命年岁内的收入&quot;逸失&quot;，也就是给与受害人共同生活的家庭共同体造成了应得财产的损失。因此，死亡赔偿金应当是一种物质损失。我国《国家赔偿法》所确定的赔偿的原则为受害人的物质损害的范围，其将死亡赔偿金也列入赔偿的范围之列，也就是确定了死亡赔偿金的财产性质地位。死亡赔偿金是事故责任人支付给交通事故死亡当事人的法定继承人或其他享有继承权的人定额化的死亡赔偿金。<br />　　 1、死亡赔偿金的计算标准，是按照受诉法院所在地上一年度城镇居民人均可支配收入或者农村居民人均纯收入标准来计算。死亡赔偿金是结合受害人的身份来确定，赔偿标准订了二等，第一等；城市居民按照受诉法院所在地上一年度城镇居民人均可支配收入赔偿；第二等，农村居民，是按照受诉法院所在地上一年度农村居民人均纯收入标准来计算。普遍的以户籍为准，城镇户籍的，死亡赔偿金按照城镇居民人均可支配收入标准计算，农村户籍的，以农村居民人均纯收入标准计算。在同一个事件中受害，用不同的标准来赔偿，应该说有问题，但这是规定。最高法院司法解释确定的死亡赔偿采取的是&quot;继承丧失说&quot;理论，确认死亡赔偿金是对未来收入的减少的补偿，根据我国目前的情况，农村户籍人员在城镇就业或者安家、定居的情况及其普遍，这部分农村户籍人员的收入、生活支出与城镇户籍的人并无什么不同，因此以死者经常居住地作为适用城镇标准或农村标准的条件更公平、更切合实际，也更符合立法原意。<br />　　2、最高法院的司法解释根据客观计算方法，以定型化赔偿模式来确定死亡赔偿金的赔偿标准和赔偿年限，具体为：就是一次性赔偿20年，死亡赔偿是固定的，受害人是60周岁以上的，年龄每增加一岁减少一年，75周岁以上的，按5年计算。死亡赔偿金赔偿的对象是余命，但又不完全是余命，如果年龄太小，赔偿20年就完了，年龄大一点的就是年龄每增加一岁就减少一年。死亡赔偿金采纳了系&quot;继承丧失说&quot;，并非精神抚慰金，其计算公式为：</p>
<p>　　（1) 城镇居民为：死亡赔偿金＝上一年度城镇居民人均可支配收入&times;20年[60周岁以上的为（实际年龄－60）；75周岁以上为5年]</p>
<p>　　（2) 农村居民为：死亡赔偿金＝上一年度农村居民人均可支配&times;N［N：60周岁以下为20年（含）；60周岁以上：N＝（实际年龄－60）；75周岁以上为5年］</p>
<p>　　 (3) 60周岁以下人员的死亡赔偿金=上一年度城镇居民人均可支配收入(农村居民人均纯收入)&times;20年。</p>
<p>　　(4）60周岁-75周岁人员的死亡赔偿金=上一年度城镇居民人均可支配收入(农村居民人均纯收入)&times;[20-(实际年龄-60)]。</p>
<p>　　(5)75周岁以上人员的死亡赔偿金=上一年度城镇居民人均可支配收入(农村居民人均纯收入)&times;5年。</p>
<p>　　3、就高不就低的特殊赔偿原则。第30条规定的就是特殊情形下的死亡赔偿金和残疾赔偿金的标准。死亡赔偿金和残疾赔偿金不一致的计算方法，受害人举证证明其住所地或者经常居住地城镇居民人均可支配收入或者农村居民人均纯收入高于受诉法院所在地标准的，残疾赔偿金或者死亡赔偿金可以按照其住所地或者经常居住地的相关标准计算，如果低的可以按照受诉法院所在地的标准赔偿，尽可能的给受害人多赔偿一些。　　<br />　　4、实际赔偿的金额的确定以及一次性赔偿原则。第31条规定的是实际赔偿的金额的确定以及一次性赔偿原则。　这条说什么呢？就说第19条至第29条规定的人身损害赔偿的具体赔偿项目，对于这些人身损害赔偿项目都要实行过失相抵，就是司法解释第2条当中提到的，按照《民法通则》第131条以及本解释第2条的规定，实行过失相抵。凡是赔偿权利人对于损害的发生或者扩大具有故意或者过失的，都应当实行过失相抵，分担损失。<br />　　5、选定受诉法院。死亡赔偿金是按照受诉法院地的标准计算，因此受诉法院地的选择与死亡赔偿金的数额有密切联系。按照民事诉讼法的法院管辖规定，交通事故案件中有管辖权的法院一般为：被告住所地法院、交通事故发生地法院，当事人在起诉前可查阅当地统计部门的统计数据，选择标准高的法院所在地法院管辖更为有利，在选择受诉法院时同时需考虑诉讼的成本，如路途远近、赔偿标准的差异比例、在当地诉讼是否方便、地方性保护等因素予以综合考虑。<br />　　6、 死亡赔偿金的性质及分配 。由于交通事故致人的非正常死亡，不但造成该公民生命的丧失，同时也给死者亲属及家庭造成了极大的伤害，这种伤害不仅表现在物质上的极大损失，而且精神上的创伤及痛苦更是无法用语言表达的。但是人死不能复生，一个人的生命是无论用多少金钱也换不来的。对死者亲属的精神伤害和物质损失又是客观存在的。我国法律在处理交通事故中规定了死亡赔偿金，还是考虑到上述因素，从实际出发，对死者亲属精神上受到的痛苦以金钱补偿的形式进行安慰。这不仅是一种抚慰，而且在道义上也是对肇事者不法行为的谴责。它反映了法律对生命权的保护得到了加强，也是对生命权予以重视的表现。同时，有的死者生前或以后是家庭经济的主要来源，其死亡造成家庭经济收入水平下降也是客观存在的，给予一定的死亡补偿费，也兼有一定的经济补偿的性质。由于死亡赔偿金兼有精神抚慰和经济补偿的双重性质，对于该款项的分配，应当依照立法上设立该款项的目的，并结合我国现实生活的实际情况来确定领受人的范围和分割原则。领受人应确定在死者的配偶和直系亲属的范围之内，因为他们所受到的精神创伤及物质损失是最大的，同时由于死者的非正常死亡，造成了家庭的残缺，对于生活、工作等方面影响最大的，也是死者的配偶和直系亲属。至于具体的分配比例，只能确定一个原则，由公安机关或人民法院按照实际情况灵活掌握，应以安定死者家属的生活为主，精神补偿为辅。死者的配偶及与死者死亡时共同生活的直系亲属应当多得，与死者死亡时未在一起共同生活的直系亲属可以给予适当的补偿即可。</p>
<p>　　7、如果交通事故赔偿权利人举证证明其住所地或经常居住地的城镇居民人均可支配收入或者农村居民人均纯收入高于其标准的，死亡赔偿金可以按照其住所地或者经常居住地的相关标准计算。广东省关于道路交通安全法施行后处理道路交通事故案件若干问题的意见中规定：受害人的户口在农村，但发生交通事故时已在城镇居住一年以上、且有固定收入的，在计算赔偿数额时按城镇居民的标准对待。<br /><br /></p>
