<title>新劳动合同法扩大了适用范围</title>

<![CDATA[<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;劳动法自１９９５年１月１日起施行后，一些新的用工主体、用工形式不断出现：民办非企业单位、基金会等新单位类型出现；一些国家机关、事业单位、社会团体在编制外招用劳动者；国家在事业单位试行人员聘用制度。 </p>
<p><font face="宋体">&nbsp;&nbsp;&nbsp;&nbsp;规定我国境内的企业、个体经济组织、民办非企业单位等组织与劳动者建立劳动关系，订立、履行、变更、解除或者终止劳动合同，适用本法。也就是在适用范围中增加了民办非企业单位等组织及其劳动者。 </font></p>
<p><font face="宋体">&nbsp;&nbsp;&nbsp;&nbsp;规定事业单位与实行聘用制的工作人员订立、履行、变更、解除或者终止劳动合同，法律、行政法规或国务院另有规定的，依照其规定；未作规定的，依照本法有关规定执行。也就是明确事业单位与实行聘用制的工作人员之间也应订立劳动合同，但考虑到事业单位实行的聘用制度与一般劳动合同制度存在一定差别，允许其优先适用特别规定。 </font></p>
<p><font face="宋体">&nbsp;&nbsp;&nbsp;&nbsp;规定国家机关、事业单位、社会团体和与其建立劳动关系的劳动者，订立、履行、变更、解除或者终止劳动合同，依照本法执行。也就是除公务员和参照公务员法管理的人员，以及事业单位中实行聘用制的工作人员外，国家机关、事业单位、社会团体与其他劳动者均应当建立劳动关系，并执行本法。</font></p>]]>

<title>什么情况由劳动者承担违约金？</title>

<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 劳动合同约定的违约金，指的是劳动合同中约定的在用人单位或者劳动者违反了劳动合同中其他有关约定时，应当向对方支付的赔偿金。但部分用人单位滥用违约金条款，侵害了劳动者自主择业权。为防止此类侵权行为的发生，劳动合同法规定，只有在两种情形下，用人单位可以约定由劳动者承担违约金。 </p>
<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;在培训服务期约定中可以约定违约金。用人单位为劳动者提供专项培训费用，对其进行专业技术培训的，可以与劳动者订立协议，约定服务期。违约金的数额不得超过用人单位提供的培训费用。用人单位要求劳动者支付的违约金不得超过服务期尚未履行部分所应分摊的培训费用。 </p>

<title>医疗事故损害赔偿纠纷案民事判决书</title>

<p>　　原告杨&times;与被告射阳县&times;医院（以下简称县&times;医院）医疗事故损害赔偿纠纷一案，本院于2005年12月19日作出[2004]射民一初字第2193号民事判决，判令被告赔偿原告医疗费1640元、交通费1504.7元、住宿餐饮费1412.8元、文检鉴定费1000元、精神损害抚慰金29328元、死亡赔偿金167712元，合计202317.5元（重审注：合计应为202597.5元）。被告不服，提出上诉，盐城市中级法院于2006年3月10日作出[2006]盐民一终字第293号民事裁定，以原判认定事实不清、适用法律不当为由，撤销原判，发回重审。本院于2006年4月17日重新登记立案，由副院长王宇华、民一庭庭长周彦河、民一庭审判员王正秀另行组成合议庭，于2006年5月19日上午公开开庭重新审理了本案。本案原告杨&times;及其代理人丁&times;&times;，被告代理人张&times;&times;、任&times;&times;，到庭参加诉讼。本案现已重审终结。</p>
<p>　　原告杨&times;在原审中诉称：2004年5月25日下午5：45，原告丈夫刘洋因腹部不适，到被告医院就诊，告知医生跌跟头、脾肿大。医生起初检查不全面、诊断错误，耽搁了腹内大量出血的治疗时间，导致刘洋手术后于次日凌晨4：35死亡。被告的医疗措施存在明显过错，与刘洋死亡具有直接因果关系。故要求被告按照《中华人民共和国民法通则》（以下简称《民法通则》）和最高法院《关于审理人身损害赔偿案件适用法律若干问题的解释》规定的赔偿项目、标准，向原告赔偿医疗费、交通费、住宿费（含餐饮费）、丧葬费、精神损害抚慰金、死亡赔偿金等损失合计265995.6元。</p>
<p>　　被告县&times;医院在原审中辩称：被告为患者刘洋诊疗过程中无医疗过失行为，处治及时，诊断准确，手术无误，患者因自身不可逆转的病情恶化而导致死亡。因诉讼中已经鉴定为医疗事故且医方承担主要责任，故被告同意按照《医疗事故处理条例》规定的赔偿项目、标准，赔偿医疗费6880.5元、交通费1880.88元、住宿费1766元、丧葬费3000元、精神损害抚慰金（按最长赔偿年限6年算）43992元之和57519.38元的70％即40263.56元。被告不同意按照《民法通则》和最高法院《关于审理人身损害赔偿案件适用法律若干问题的解释》的规定支付死亡赔偿金。</p>
<p>　　原告杨&times;在重审中将请求数额进一步明确为：医疗费实交3000元、交通费1880.88元、住宿费（含餐饮费）1766元，均按80％计算；丧葬费，同意以被告原审中提出的3000元数额，再按80％计算；文检鉴定费1000元；精神损害抚慰金50000元；死亡赔偿金，以人身损害赔偿案件中的死亡赔偿金标准，按80％计算为167712元；合计226429.5元。</p>
<p>　　被告县&times;医院在重审中补充辩称：除精神损害抚慰金、死亡赔偿金之外，被告同意原告提出的其他赔偿项目计算基数。</p>
<p>　　原告杨&times;在原审中提交的证据有：1、原告丈夫刘洋在县&times;医院就诊的门诊病历复印件1份；2、户口本复印件1份、结婚证1份；3、县城市规划办公室2005年11月29日出具的证明1份，内容为：&ldquo;我单位已故职工刘洋的遗孀未来领取丧葬费&rdquo;；4、原告申请本院委托江苏省高级法院对县&times;医院2004年5月25日麻醉同意书上&ldquo;拟于&hellip;&hellip;手术&rdquo;时间予以鉴定的，2005年3月10日苏高法司文鉴字（2005）第28号文检鉴定书1份；文检鉴定费收据1张，金额为1000元；5、医疗费已交金额3000元、交通费金额1880.88元、住宿费（含部分餐饮费）金额1766元的票据一组。</p>
<p>　　原告杨&times;在重审中根据本院要求提交的证据有：县政府2004年11月1日射政复[2004]53号《关于同意认定刘洋同志因公牺牲的批复》复印件1份。</p>
<p>　　被告县&times;医院在原审中提交的证据有：1、被告开具的编号为0064062的住院医药费收费收据复印件1份，姓名为刘洋，金额为6880.5元；2、姓名为刘洋的住院病案、病历记录1套；3、被告申请本院委托盐城市医学会进行医疗事故技术鉴定，市医学会2005年6月21日出具的盐城医检[2005]38号医疗事故技术鉴定书1份；4、被告申请本院委托江苏省医学会再次进行医疗事故技术鉴定，省医学会2005年11月1日出具的江苏医鉴[2005]130号医疗事故技术鉴定书1份。</p>
<p>　　经原审及重审质证，除原告对被告提交的刘洋住院病案、病历记录中部分内容不予认可外，双方对对方提交的证据的真实性不持异议。</p>
<p>　　本案重审中，原、被告双方对下列各节事实无异议，本院予以确认：</p>
<p>　　一、关于患者刘洋的身份。刘洋，系原告杨&times;丈夫，生前担任县规划建设局建设科负责人、县城市规划办公室党支部书记。</p>
<p>　　二、关于刘洋就诊的经过。据省医学会出具的江苏医鉴[2005]130号医疗事故技术鉴定书记载：</p>
<p>　　患者刘洋，男，51岁，因上腹部外伤于2004年5月25日17：50左右去县&times;医院门诊就诊，后由门诊转急诊，查体：BP：90/60mmHg，P:90次/分，律齐，无杂音，腹澎隆，肝肋下未及，脾肋下6cm，质韧，肝区扣痛（－），腹水症（&plusmn;），剑突下轻压痛。当日20：45因左上腹痛伴晕厥4小时，腹痛加剧伴心悸、胸闷1小时予急诊住院，入院后查体：BP：80/30mmHg，HR84次/分，脉弱不可及，神志淡漠，腹澎隆，左上腹剧烈压痛，移动性浊音（＋）。腹腔穿刺：不凝血。B超提示腹腔积液。血常规血小板25&times;109L，于21：15急送手术室行剖腹探查术，术中见腹腔内血约7500ml，脾胃韧带上缘见血管喷涌样出血，胃短血管撕裂出血，乃行出血血管结扎及脾脏切除术，并予输血3600ml，输血小板4u。次日2：30返回病房，予扩容、抗肾衰、保肝治疗，患者于4：33死亡。死亡诊断：胃短血管撕裂出血伴急性失血性休克，急性肾衰，急性肝病，弥漫性血管内凝血（DIC），肝炎后肝硬化，脾肿大伴脾机能亢进。</p>
<p>　　三、关于被告县&times;医院的医疗过失。市、省两级医学会的医疗事故技术鉴定书的分析意见、结论均一致，但市医学会出具的盐城医检[2005]38号医疗事故技术鉴定书的分析意见较为详细。其中记载：</p>
<p>　　1、县&times;医院存在以下医疗过失行为：⑴根据省高级法院文检鉴定的时间为晚上10：30，从就诊至进手术室的时间共约4小时左右，延误了外伤性胃短血管撕裂出血手术止血的最佳时间；⑵术前数小时未采取行之有效的抗休克治疗；⑶首诊询问病史不详、无病历记载；⑷术前对腹部外伤史未引起足够重视；⑸有病历涂改可能。</p>
<p>2、上述医方存在的医疗过失行为与患者的死亡存在直接因果关系。</p>
<p>　　3、患者原患肝炎后肝硬化、脾肿大、脾亢、外伤性胃短血管撕裂出血，手术风险大，是术后患者的死亡因素之一。考虑上述因素，医方的医疗过失行为对患者的死亡承担主要责任。</p>
<p>　　四、关于医疗事故鉴定的结论。市、省两级医学会的医疗事故技术鉴定书的结论一致：本病例属于一级甲等医疗事故，医方承担主要责任。</p>
<p>　　五、关于原告已支出的费用金额。1、刘洋医疗费，总额为6880.5元，其中原告预交3000元、被告垫付3880.5元；2、交通费，总额是1880.88元；3、住宿费，总额（含部分餐饮费）是1766元；4、丧葬费，双方虽未提供本地关于当前丧葬费补助标准的文件，但均同意按3000元计算；5、文检鉴定费，金额为1000元。</p>
<p>　　六、关于麻醉同意书时间的涂改。县&times;医院2004年5月25日麻醉同意书上&ldquo;术前诊断腹腔内出血，拟于2004年5月25日20：30时行剖腹探查术手术&rdquo;一句中的&ldquo;20：30&rdquo;，经省高级法院苏高法司文鉴字（2005）第28号文检鉴定书确认为：&ldquo;20：30被涂改前系10：30&rdquo;（重审注：此处10：30应指晚上10：30）。</p>
<p>　　七、关于刘洋因公牺牲的抚恤。2004年11月1日，县政府以射政复[2004]53号《关于同意认定刘洋同志因公牺牲的批复》批复县民政局、县人事局，认定刘洋系因公牺牲。有关部门按照政策规定向其遗属发放抚恤金。</p>
<p>　　八、关于2004年度有关统计数据。根据江苏省2005年统计年鉴，2004年度城镇居民人均可支配收入为10482元、城镇居民生活消费支出7332元。</p>
<p>　　本案庭审归纳的争议焦点是：被告县&times;医院应否向原告杨&times;支付死亡赔偿金？原告认为，被告因医疗侵权行为导致患者死亡，按照《民法通则》和最高法院《关于审理人身损害赔偿案件适用法律若干问题的解释》的规定，被告应当支付死亡赔偿金；而被告则认为，本病例属于医疗事故，《医疗事故处理条例》未规定&ldquo;死亡赔偿金&rdquo;项目，故其不应支付死亡赔偿金。</p>
<p>　　这一争议焦点，涉及若干类似案件的法律适用问题，基层司法者面临着机械司法与能动司法的思维转换，面临着法律解释方法与裁判方法的调整更新，到底如何裁判才算公平正义，正是本案的难点之所在。同时，也正是本案裁判的司法意义之所在。</p>
<p>　　本院经重审认为：</p>
<p>　　被告县&times;医院针对原告杨&times;丈夫刘洋实施的医疗行为，经市、省两级医学会鉴定，均确认&ldquo;医疗过失行为与患者的死亡存在直接因果关系&rdquo;、&ldquo;属于一级甲等医疗事故，医方承担主要责任&rdquo;，故被告县&times;医院应当依照法律、行政法规、司法解释的具体规定，承担与其医疗过错程度相适应的民事侵权赔偿责任。分述如下：</p>
<p>　　一、原告杨&times;诉讼请求之中，对照《医疗事故处理条例》第五十条有着明确规定的赔偿项目，被告县&times;医院可以按照该条确定的赔偿标准予以赔偿。</p>
<p>　　1、医疗费、交通费、住宿费、丧葬费项目，在《医疗事故处理条例》第五十条第（一）项、第（七）项、第（九）项、第（十）项和第五十一条中有明确规定。本案中，这四个赔偿项目的基数，可以按照原、被告双方认可的数额确定。</p>
<p>　　2、精神损害抚慰金项目，《医疗事故处理条例》第五十条第（十一）项作了明确规定。精神损害抚慰金计算公式是：本地居民年平均生活费（本案中，可参照2004年度本省城镇居民生活消费支出数据7332元）&times;赔偿年限，赔偿年限&le;6年。</p>
<p>　　二、原告杨&times;诉讼请求之中，对照《医疗事故处理条例》第五十条没有规定的赔偿项目，即&ldquo;死亡赔偿金&rdquo;项目，被告县&times;医院应当按照《民法通则》第一百一十九条以及最高法院《关于审理人身损害赔偿案件适用法律若干问题的解释》第十七条、第二十九条确定的赔偿标准予以赔偿。</p>
<p>　　近年来，医院与患者之间的医患矛盾渐趋凸显，医疗纠纷案件数量逐步上升。国务院颁布的《医疗事故处理条例》自2002年9月1日实施以后，特别是最高法院2003年1月6日发出《关于参照〈医疗事故处理条例〉审理医疗纠纷民事案件的通知》以后，医疗纠纷案件审理实践中一度出现了适用法律&ldquo;二元化&rdquo;现象：对于医疗事故引起的医疗赔偿纠纷案件，适用《医疗事故处理条例》；对于非医疗事故引起的医疗赔偿纠纷案件，则作为一般的人身损害赔偿案件，适用《民法通则》及相关司法解释。</p>
<p>　　《医疗事故处理条例》与《民法通则》规定的赔偿项目、赔偿标准是不一致的：前者的赔偿项目比后者少，典型的缺少项目是死亡赔偿金；相同项目或类似项目的赔偿标准，前者大多数比后者低。自最高法院《关于审理人身损害赔偿案件适用法律若干问题的解释》于2004年5月1日实施以后，又进一步扩大了它们的差距。这样适用法律&ldquo;二元化&rdquo;现象的直接后果往往就是，导致两种类型的医疗纠纷案件裁判结果明显有失公平：医疗行为构成医疗事故，医院过错程度较重，但赔偿数额较少；医疗行为不构成医疗事故，医院过错程度较轻，但赔偿数额较多。这种不公平的处理结果，背离了类似案件类似处理的裁判原则，背离了重错重处、轻错轻处的裁判尺度，背离了强调&ldquo;公平正义&rdquo;价值追求的社会主义法治理念，①也降低了医疗纠纷案件裁判的群众认同度和社会公信力。法院无法自圆其说、令人信服地向人民群众和社会各界解释两类医疗纠纷案件重错轻处、轻错重处的合法性、合理性，法院不应说出&ldquo;这是合法不合理&rdquo;之类的推诿之辞。法院办案既不能恣意，也不能机械，应当体现法律的精髓，应当符合群众要求公平对待的朴素情理。最高法院有司法者曾精辟地指出：&ldquo;一个优秀的法官，应当能够正确地把握法律制度所预设的价值追求，并将自己对法的价值的认识融于法律的解释之中，以作出符合法的价值精神的公正裁判。但是，我国现阶段的执法者，还有相当一部分不具有较高法的价值修养，因而时常出现实施具体的法律制度和规范时，背离了法的价值精神。当这种情况出现时，虽然他们感到似乎存在某种问题，实施法律的结果有悖于生活之情理，但由于他们缺乏法的价值修养，并不能清楚地认识到问题的存在。于是，便感叹：合法不合理！甚至还标榜自己是严格的执法者。&rdquo;&ldquo;合法的应当是合情理的，这取决于法官怎样去理解法律，如何把握法的价值。将法律规范适用于处理具体的案件，并不是一个死板、机械的过程，而是一项创造性的活动。真正理解和把握了立法的精神和价值，就能够&hellip;&hellip;正确地解释和运用法律，作出合乎法律又合乎情理的公正裁判。&rdquo;②</p>
<p>　　如何消解医疗纠纷案件适用法律&ldquo;二元化&rdquo;现象，医疗界倾向于医疗纠纷案件一律适用《医疗事故处理条例》，基层司法界倾向于医疗纠纷案件一律适用《民法通则》和《关于审理人身损害赔偿案件适用法律若干问题的解释》，法学界尚无定论，最高立法机关和最高司法机关亦未一槌定音。然而，法院不能因为某个争议问题缺乏最高决策机关的权威性结论而拒绝作出裁判，法院必须保障当事人就其争议能够及时获得裁判的权利。鉴此，本院在重审本案过程中，经过慎重考量、权衡利弊，秉承司法功能应在谦抑与能动之间寻求平衡、寻求更优的价值取向，谨提出如下解题思路：③</p>
<p>　　1、司法判断的价值基础：患者的生命健康权重于医院的运行发展权。</p>
<p>　　国务院《医疗机构管理条例》规定医院的宗旨是，救死扶伤，防病治病，为公民的健康服务。从国家和社会的角度看，医院必须保障患者的生命健康权；从患者的角度看，医疗行为造成人身损害赔偿的项目、标准，不应少于、低于一般人身损害赔偿案件中的项目、标准；而从医院的角度看，医学具有特殊性，医疗具有风险性，医院具有公益性，赔偿项目增多、标准增高必然加大医院的运行成本，不利于医院的正常运转和发展。司法者裁判医疗纠纷案件时的着眼点，不应从医患一方的角度看，而应从国家和社会的角度看，设立医院的根本价值就在于保护患者的生命健康，患者的生命健康权始终重于医院的运行发展权，不能把牺牲人民群众的健康利益作为医疗事业的发展成本。这也是以人为本的体现。况且，卫生部、国家中医药管理局也都强调医院&ldquo;以病人为中心&rdquo;。④基于这一价值基础，司法者裁判医疗纠纷案件时选择适用的法律依据及其赔偿项目、标准应当有利于患者。</p>
<p>因此，本案中原告索赔的&ldquo;死亡赔偿金&rdquo;项目，既然《医疗事故处理条例》未作规定，那么被告县&times;医院就应当按照《民法通则》以及最高法院《关于审理人身损害赔偿案件适用法律若干问题的解释》确定的赔偿标准予以赔偿。《民法通则》第一百一十九条规定&ldquo;侵害公民身体造成伤害的，应当赔偿医疗费、因误工减少的收入、残废者生活补助费等费用；造成死亡的，并应当支付丧葬费、死者生前扶养的人必要的生活费等费用。&rdquo;该条中后一个&ldquo;等费用&rdquo;，最高法院《关于审理人身损害赔偿案件适用法律若干问题的解释》第十七条第三款已将其明确包括&ldquo;死亡补偿费&rdquo;（即死亡赔偿金）
